Nebraska aboveground fuel tank permits

Nebraska's State Fire Marshal administers installation permits for new and replacement petroleum aboveground tanks and piping.

Installation permit and plan review

Official Fire Marshal guidance calls for an application, detailed site plan and $50 review fee per installation, submitted at least ten working days before installation. Ask whether a delegated local jurisdiction handles the review.

Important timing conflict to verify

The Fire Marshal's current website says to notify its Fuels Division at least 72 hours before installation, but the separately published Title 153 Chapter 17 PDF specifies at least 24 hours. Confirm the operative notice requirement with the agency before scheduling work.

Check the right program

Nebraska's aboveground installation permit is different from the underground tank registration program. Verify fuel type, tank capacity, local approval, spill prevention and federal SPCC separately.

Example: farm or contractor fuel yard

Before arranging delivery of a new tank, prepare a site sketch showing the fuel, tank and piping configuration, fill and dispensing locations, surrounding structures and vehicle access. Ask the Nebraska State Fire Marshal's Fuels Division whether it or a delegated local office will review the installation and what notice timing currently applies. Build time into the schedule for the permit and review rather than treating installation day as the first approval step.
