New York jurisdiction guide
New York aboveground fuel tank requirements
New York tank projects require two different maps: the environmental storage program and the applicable local fire code.
DEC petroleum bulk storage may require registration
The New York Department of Environmental Conservation states that its Petroleum Bulk Storage program covers facilities exceeding 1,100 gallons in combined petroleum storage, subject to exclusions, and certain other facilities. Used-oil tanks have specific registration treatment. Check the entire facility and product rather than judging one tank in isolation.
The 2025 Uniform Code is current outside NYC
New York State's 2025 Uniform Fire Prevention and Building Code became effective December 31, 2025. New York City administers a separate code framework. For any site, determine the actual local code enforcement authority before planning setbacks, dispensing or construction.
County administration can differ
DEC identifies counties with locally administered bulk-storage arrangements. Verify the correct administering agency and its current forms before filing, particularly in counties with delegated program responsibilities.
Example: multiple tanks at one facility
When a fleet yard uses several tanks, evaluate the facility-wide petroleum storage alongside each tank's size and product. Ask the DEC or delegated county authority whether the facility enters the Petroleum Bulk Storage program, then confirm which authority handles fire-code permits. The requirements may change if the same project is located in New York City rather than elsewhere in the state.
What to gather for PBS review
List each petroleum-containing tank, individual capacities, total facility storage, locations and uses, and any existing facility registration. Identify the county and local fire authority before selecting application forms. Do not assume that a tank replacement can reuse an old registration or fire approval without review.
Plan state and local approvals together
Document facility-wide capacity, tank type, stored product, delivery method, containment, local zoning/site review, fire permits, registration and federal SPCC applicability.
Do not assume
A DEC registration is not the same as a fire-code permit, and a New York City project should not simply reuse the general statewide fire-code checklist.
