Important: These state thresholds apply only to the named programs and qualifying tanks. Confirm exclusions and local AHJ requirements for your site.

Start with the regulated-tank definition

Pennsylvania DEP generally regulates stationary aboveground storage tanks containing regulated substances when system capacity is greater than 250 gallons, subject to specific exemptions. Confirm the stored product, tank configuration, and exceptions before applying the threshold.

Registration and annual fees

Regulated ASTs require DEP registration and applicable annual fees. DEP's current registration guidance lists annual fees of $50 for ASTs of 5,000 gallons or less, $125 for 5,001–50,000 gallons, and $300 above 50,000 gallons. Confirm current fees before budgeting.

Permits, qualified installers and inspections

DEP distinguishes operating and installation permits. Regulated systems need an operating permit; certain installations also require a site-specific installation permit. DEP calls for properly certified tank handlers and inspectors for regulated tank work. Verify project-specific requirements early with DEP.

Local fire approval and SPCC are separate

A DEP registration is not a local installation/fire-code approval. Ask the municipal fire/building authority to confirm the applicable fire-code edition, dispensing and site-review requirements. Determine federal SPCC applicability separately; Pennsylvania's 250-gallon threshold is not a federal SPCC trigger.

Buyer checklist

Document site address, fuel type, tank size and arrangement, existing tanks, containment, fill and dispensing points, access, drainage and fire protection. Ask DEP whether the exact tank is regulated, what permit sequence applies, and which certified tank company must inspect or install it. Obtain the local AHJ's current requirements before buying.
