Aboveground fuel storage tank requirements in Wyoming

Wyoming uses the 2024 International Fire Code and requires plan review for aboveground flammable or combustible liquid tanks. A separate DEQ storage-tank program matters when the tank is used by a fuel dealer to sell gasoline or diesel to the public.

Do not install first and ask later. Wyoming's State Fire Marshal lists aboveground flammable/combustible-liquid tank installations and dispensing facilities as plan-review projects. Plans must be approved before work begins unless an authorized local jurisdiction has the applicable enforcement authority.

Current statewide code: 2024 IFC

Wyoming adopted the 2024 International Fire Code effective June 28, 2024. The State Fire Marshal's current plan-review page says new submissions must comply with the adopted 2024 codes and referenced standards.

AST installations require fire-safety plan review

Wyoming's plan-review program specifically includes installations of aboveground storage tanks and dispensing facilities for flammable or combustible liquids. The State Fire Marshal requires complete plans and specifications and states that no work may begin before the Permit to Construct is issued. State law also bars installation from beginning before the plans are approved, subject to jurisdictions with delegated local enforcement authority.

Public fuel sales add a separate DEQ layer

Wyoming DEQ's Storage Tank Program regulates aboveground tanks used by fuel dealers to dispense gasoline or diesel for retail sale. That public-sale definition matters. A private fleet tank is not automatically in the same DEQ AST program simply because employees dispense diesel from it, although the fire-code plan review and federal SPCC analysis can still apply.

Private fleet and industrial tanks still need the fire-code path

For a contractor yard, mine support facility, ranch, fleet, generator installation, or industrial site that is not selling motor fuel to the public, start with the fire-code authority and the site-specific plan-review process. Then separately test the facility for federal SPCC applicability.

Example: fleet yard versus retail fueling

For a Wyoming fuel-storage project, clarify whether the tank supplies the company's own equipment or sells fuel to the public. Build the Fire Marshal's site-plan review into either schedule, then determine whether the separate DEQ program for public fuel sales applies. Provide tank drawings, site layout and dispensing details before requesting a determination.

What to confirm before ordering

  • Whether the State Fire Marshal or an authorized local jurisdiction has plan-review authority
  • Whether the tank will dispense fuel for public sale or only for private operations
  • Tank listing, setbacks, venting, containment, electrical, and impact protection
  • Dispensing layout and emergency controls
  • Federal SPCC applicability for the facility
