Fuel storage tanks fall into two categories with genuinely different regulatory paths: aboveground (AST) and underground (UST). Different regulators, different rulebooks

USTs are regulated primarily through EPA's UST program (40 CFR Part 280) and state UST offices, focused on leak detection, corrosion protection, and release response for tanks buried in the ground. This typically means mandatory release detection equipment, periodic testing, and — in most states — formal registration with a state UST program office, often with an associated fee. ASTs fall instead under SPCC and NFPA 30/30A, focused on visible secondary containment and fire/life-safety siting, which is a self-implemented plan and a local fire code permit rather than a state UST registration process. If your facility already deals with SPCC for other reasons, staying aboveground keeps you in one regulatory lane rather than two.

Why most industrial and commercial buyers choose AST

Aboveground tanks are faster to install (no excavation), easier to inspect visually for leaks or corrosion, simpler to relocate or resize as operations change, and typically lower-cost over the tank's service life since there's no soil remediation risk if a failure occurs. When UST still makes sense

Underground tanks remain the right call when surface space is genuinely constrained, when aesthetic or zoning requirements prohibit visible tanks, or in cold climates where burial provides passive freeze protection that an aboveground tank would need active heating or insulation to match. Retail fuel dispensing facilities, where visible tanks would consume valuable forecourt space, are a classic UST use case. These are real trade-offs — not reasons to default to UST without evaluating the AST alternative first.

Ongoing compliance burden compared

Beyond the initial install decision, ongoing compliance looks different too. USTs generally require periodic release detection testing, inventory reconciliation, and — depending on your state — formal registration renewal. ASTs generally require periodic visual inspection of the tank and containment system, documented as part of your SPCC plan. Neither is trivial, but AST's inspection burden is typically lower-cost and easier to self-manage since everything is visible without specialized monitoring equipment.
